Student/Young Adult Power Of Attorney (POA)

Every incoming college student needs books, toiletries, bedding, computers and more before they go off to college. And every parent needs a signed power of attorney before sending them off. 

A Power Of Attorney (POA)  is a legal document every parent should have their 18-year-old sign that would give the parent immediate authority to access medical and financial information to handle issues on behalf of the young adult, in case of an emergency.

Without a POA, parents may not be able to help their children if they need it. Parents, even though you  still view your 18-year-old as your baby, the law sees them as adults. Adult/Senior Power Of Attorney (POA)

As much as it may hurt to think about, there will come a time when your aging parent may no longer be capable of making decisions about financial and legal matters or about health care. At that point you’ll need to be prepared to step into a decision-making role. Before that time comes, it’s important to discuss the subject of designating a power of attorney.

Powers of attorney are legal documents authorizing you to make decisions on the behalf of an incapacitated family member. The person executing the document (your parents) is known as the “principal” and the person chosen to act on the principal’s behalf is known as the “agent”. A POA can cover the decisions that your parents would have to make such as health care, medical treatments, financial deals, contracts, wealth management, etc. A POA can be given to one person or can be shared, for example, between siblings.

The State of California recognizes four different types of powers of attorney:

While a standard POA expires when the principal (you) becomes incapacitated, a Durable POA gives authority to the agent to act for you if you become incapacitated. We hate to think of the possibility of an accident or serious illness, and even more the potential negative effects of aging.
